General Terms of Use

This document/understanding/agreement is a computer-generated electronic record published in accordance with Rule 3 of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended from time to time), read with the Information Technology Act, 2000 (as amended from time to time). It does not require any physical or digital signatures. These Terms, including any annexures, schedules, and links provided herein, govern your use of all products and services available on the bizbuzz.co.in website, including but not limited to linked pages, API keys, features, content, and application services (including any mobile applications or mobile site services) (“Website”). The Website is owned and operated by bizbuzz.co.in.

In this agreement: The terms “We,” “Us,” and “Our” refer to bizbuzz. The terms “You,” “Your,” “Yourself,” or “Merchant” refer to any individual, business entity, or corporate body (registered or non-registered) using or accessing the Website and Services, including merchants associated with bizbuzz. The term “Applicable Laws” shall include: any law, statute, rule, regulation, order, circular, decree, directive, judgment, decision, or other similar mandate issued by a central, state, or local government/regulatory authority with competent jurisdiction and force of law, as amended from time to time; and notifications, circulars, directives, or similar instructions issued by Financial Sector Regulators, including (but not limited to) the Reserve Bank of India (RBI), and the rules, regulations, roles, responsibilities, and processes defined by the National Payments Corporation of India (NPCI), available at www.npci.org.in.

2. DEFINITIONS.
   
   2.1 CONFIDENTIAL INFORMATION: All information collected by the Mobile Application for the purpose of creating an account, as well as any information collected in the future to maintain, upgrade, or deactivate the account, shall be deemed the Confidential Information of the User. 2.2 USER: A User shall be any person who has attained the age of majority and is of sound mind. Any person, irrespective of nationality, shall be considered a User of this Mobile Application. A User is an individual who utilizes the services provided by the application. The User has a duty to adhere to all the provisions laid down in this User Agreement. The User assures that the services of bizbuzz will be used only for legitimate purposes. 2.3 MOBILE APPLICATION: The bizbuzz application (available on Android, iOS, and Chrome Webstore platforms) shall be referred to as the “Mobile Application” under this User Policy. The application constitutes the intellectual property of bizbuzz.co.in. 2.4 INTELLECTUAL PROPERTY: All trademarks, copyrights, application content, logos, words, terminologies, software codes, and related intellectual assets belong to bizbuzz.co.in. 2.5 CYBER CRIME: Any action committed by a User or a third party for illegal or unlawful purposes using the services provided by bizbuzz shall be considered a cybercrime.
   
   
3. CONFIDENTIALITY.
   
   All information collected from the User shall be treated as confidential and will not be shared with any third party without due cause. However, the Mobile Application reserves the right to share basic aspects of such confidential information for the purpose of promoting the business of both the User and bizbuzz. Administrators reserve the right to study, monitor, and analyze data transmitted over messages within the bizbuzz application. Confidential information may only be shared with law enforcement agencies upon proper legal procedures being followed. Confidential information may also be shared if required for launching or integrating the application with other platforms such as iOS, Android, Google, Microsoft, etc.
   
   
4. INTELLECTUAL PROPERTY RIGHTS.
   
   All editorial content, information, photographs, illustrations, artwork, graphic materials, names, logos, and trademarks on the Mobile Application are protected by copyright laws, trademark laws, and international treaties, and belong to bizbuzz.co.in and/or its suppliers. These works, logos, graphics, sounds, or images may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted, or circulated in whole or in part, unless expressly permitted by bizbuzz and/or its suppliers. Nothing on the Mobile Application shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed without prior written permission. Misuse of trademarks or other content is strictly prohibited. bizbuzz will take legal action against any unauthorized use of its trademarks, name, or symbols to preserve and protect its rights.
   
   
5. PROHIBITIONS RELATING TO USAGE OF SERVICES.
   
   Users are prohibited from illegal use of the SMS service, fraud, impersonation, reverse engineering, cybercrime, transmitting unlawful or defamatory content, sending viruses or spam, violating intellectual property rights, and any other misuse. Violations may result in penalties under the Information Technology Act, 2000 and related amendments. bizbuzz reserves the right to suspend accounts involved in prohibited activities.
   
   
6. CANCELLATION POLICY.
   
   Users may deactivate their account at any time by notifying bizbuzz customer care at support@bizbuzz.co.in. bizbuzz reserves the right to suspend or terminate services at any time without prior notice in cases of policy violations, non-renewal, or non-payment.
   
   
7. REFUND POLICY.
   
   Payments made are non-refundable, as SMS credits are immediately credited to the User’s account. Refunds will not be provided for accounts cancelled, suspended, or restricted due to policy violations. Abuse toward staff or spamming will result in suspension or termination by bizbuzz.
   
   
8. AMENDMENTS.
   
   bizbuzz.co.in may update content, descriptions, or pricing at any time without prior notice and reserves the right to amend these Terms periodically. Users are advised to review these Terms regularly.
   
   
9. DISCLAIMER AND EXCLUSION OF LIABILITY.
   
   bizbuzz agrees to protect and manage user data in accordance with applicable laws but shall not be liable for circumstances beyond reasonable control, including third-party malicious acts or force majeure events. To the fullest extent permitted by law, bizbuzz disclaims all representations and warranties and shall not be liable for direct, indirect, incidental, or consequential damages arising from use of its services.
   
   
10. TERMINATION.
    
    If a User breaches these terms, bizbuzz may suspend, terminate, or cancel this agreement and recover damages. The User may also terminate by notifying bizbuzz in writing, but any remaining credits will cease to be accessible.
    
    
11. LEGAL ACTION & DISPUTE RESOLUTION.
    
    Any disputes shall be referred to arbitration. The User agrees not to initiate proceedings contrary to this clause. bizbuzz reserves the right to initiate legal action against misuse, breach, or unlawful activity.
